TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing, browsing, or making a purchase on chloeflowerbags (the "Store," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be fully bound by these Terms of Service ("Terms"), including all policies incorporated herein by reference. If you do not agree with any part of these Terms, you must discontinue use of this Store immediately and refrain from placing any order.

These Terms constitute a legally binding agreement between you and chloeflowerbags. Your continued use of the Store or completion of a purchase constitutes your express and unconditional acceptance of these Terms.


2. ELIGIBILITY

By placing an order, you represent and warrant that: (a) you are at least 18 years of age or the age of majority in your jurisdiction; (b) you have the legal authority to enter into a binding contract; (c) you are not located in a jurisdiction where the purchase of our products is prohibited by law; and (d) all information you provide to us is accurate, current, and complete.


3. PRODUCTS AND PRODUCT DESCRIPTIONS

chloeflowerbags offers crochet tulip flower bags designed for women who appreciate unique, aesthetic, and feminine accessories. Our products feature knitted tote designs with 3D tulip-inspired details, soft pastel color palettes, and a cottagecore-inspired aesthetic intended to complement a variety of personal styles.

Manufacturing Transition Notice — Mandatory Disclosure:

Due to high consumer demand, products that were previously crafted through artisanal or handmade processes have transitioned to production in industrial manufacturing facilities. By communicating this transition in these Terms, chloeflowerbags assumes no liability for any claims arising from expectations of handmade or artisanal craftsmanship. By completing a purchase, the Customer expressly acknowledges and accepts this condition. No claim, dispute, chargeback, or refund request based on the expectation of handmade or artisanal production will be honored.

We make reasonable efforts to display product colors, textures, and details accurately; however, we cannot guarantee that your device's display will render colors identically to the physical product. Slight variations in color, stitching pattern, or finish are inherent characteristics of textile products and do not constitute defects or grounds for return or refund.

We reserve the right to modify, discontinue, or substitute any product at any time without prior notice.


4. PRICING AND PAYMENT

All prices are displayed in U.S. Dollars (USD). chloeflowerbags reserves the right to adjust prices at any time without notice. The price applicable to your order is the price listed at the time your order is confirmed.

You agree to pay in full at the time of purchase. We accept payment methods made available through our checkout system. By submitting payment, you represent that you are authorized to use the selected payment method and that the information provided is accurate.

In the event of a pricing error, we reserve the right to cancel the order and issue a full refund of the amount charged, with no further obligation to you.


5. ORDER PROCESSING AND CONFIRMATION

Order submission does not constitute a binding contract of sale until we send you an order confirmation email. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases involving suspected fraud, inaccurate product or pricing information, or stock unavailability.

Order Processing Time: All orders require 1 to 3 business days for processing before shipment. Business days are Monday through Friday, excluding federal U.S. public holidays. Processing time begins on the first business day following order placement.


6. SHIPPING POLICY

Estimated Delivery Time: Once an order has been processed and dispatched, estimated delivery time is 13 to 20 business days. This estimate is provided as a good-faith approximation and does not constitute a guaranteed delivery date.

Shipping Delays: Delivery timelines may be affected by factors beyond our control, including but not limited to: customs clearance, carrier delays, natural disasters, public health emergencies, extreme weather, labor actions, international logistics disruptions, and U.S. or foreign government actions. Such delays do not constitute a breach of contract and do not entitle the Customer to a refund, cancellation, or any form of compensation.

Non-Delivery Due to Customer Error: If a shipment is undeliverable or returned due to an incorrect address, failure to collect, or refusal of delivery by the Customer, the Customer shall bear all costs associated with reshipment. No refund will be issued for the original shipping charges.

Tracking: A tracking number will be provided once your order has been dispatched. chloeflowerbags is not responsible for inaccuracies in carrier-provided tracking information.

Title and Risk of Loss: Title to and risk of loss of products pass to the Customer upon delivery to the carrier.


7. ORDER CANCELLATION POLICY

Pre-Shipment Cancellations: You may request a cancellation only before your order has been processed and dispatched. To request a cancellation, you must contact us immediately at chloeflowerbags@gmail.com. Cancellation requests are reviewed on a best-efforts basis and are not guaranteed even during the processing window.

Post-Shipment Cancellations: Once an order has been dispatched and a tracking number has been issued, the order cannot be cancelled under any circumstances. No exceptions will be made. If you wish to return the item after delivery, you must follow the Return Policy set forth in Section 8.


8. RETURN AND REFUND POLICY

chloeflowerbags maintains a strict return policy in compliance with applicable U.S. federal and state consumer protection law. By purchasing from this Store, you agree to the following conditions in their entirety.

Return Eligibility Window: Returns are accepted within 90 calendar days of the date of delivery as confirmed by carrier tracking records.

Strict Eligibility Requirements: To be eligible for a return, ALL of the following conditions must be met simultaneously:

The item must be completely unused and in its original condition. The item must be in its original, undamaged packaging with all original seals, tags, and protective materials fully intact and unbroken. The item must show absolutely no signs of use, wear, washing, alteration, assembly, or manipulation of any kind. The item must be free from odors, stains, pet hair, and any foreign substances. Proof of purchase from chloeflowerbags must be provided.

Non-Returnable Items — Broad Exclusions: The following are expressly excluded from return eligibility and no exceptions will be made:

Items whose original packaging, seals, or tags have been opened, broken, removed, or tampered with in any way. Items that show any evidence of use or wear. Items returned without prior written authorization from chloeflowerbags. Items damaged after delivery due to Customer misuse, mishandling, improper care, or accident. Items returned beyond the 90-day return window. Items purchased during promotional or clearance sales, if designated as final sale. Any item that, upon inspection, does not meet every condition listed above.

Return Authorization Requirement: Before shipping any return, you must obtain written Return Authorization (RA) from us by emailing chloeflowerbags@gmail.com. Returns shipped without prior written authorization will be refused and returned to the sender at the sender's expense. No refund will be issued for unauthorized returns.

Return Shipping Costs: All return shipping costs are the sole responsibility of the Customer. chloeflowerbags will not provide prepaid return labels, cover return postage, or reimburse return shipping expenses under any circumstances. We strongly recommend using a trackable shipping service and purchasing shipping insurance, as we cannot be responsible for items lost or damaged in return transit.

Inspection and Refund Processing: Upon receipt of the returned item, chloeflowerbags will conduct a thorough inspection to verify compliance with all return eligibility requirements. This inspection may take up to 7 business days from the date of receipt. If the item passes inspection and meets all eligibility criteria, a refund will be issued to your original payment method within 10 business days of inspection completion.

Original Shipping Charges: Original outbound shipping charges are non-refundable under any circumstances, including cases where an order qualifies for a return or refund.

Partial Refunds: chloeflowerbags reserves the right to issue a partial refund, or deny a refund entirely, if the returned item does not fully meet all eligibility conditions upon inspection.

Logistical Delays Are Not Grounds for Refund: Extended transit times, delays in delivery, or failure to deliver within the estimated timeframe do not entitle the Customer to a refund, cancellation, or any other form of compensation, provided the order has been dispatched.

Chargebacks and Payment Disputes: Before initiating any chargeback or payment dispute with your bank or payment provider, you must contact us at chloeflowerbags@gmail.com and allow us a reasonable opportunity to resolve the matter. Initiating a chargeback without first contacting us may result in permanent ban from the Store and may be referred for further action.


9. DAMAGED OR DEFECTIVE ITEMS

If you receive an item that is materially damaged or defective upon arrival, you must notify chloeflowerbags by email at chloeflowerbags@gmail.com within 72 hours of confirmed delivery. Your notification must include your order number, a written description of the defect, and clear photographic evidence of the damage or defect and the packaging in which it was received.

Failure to report within this window may affect your eligibility for a remedy. chloeflowerbags reserves the right to determine, at its sole discretion, whether a reported condition constitutes a defect and what remedy, if any, is appropriate. Remedies may include replacement of the item, store credit, or a partial or full refund, at our sole election.


10. INTELLECTUAL PROPERTY

All content on this Store, including but not limited to text, images, graphics, logos, product names, and trade dress associated with the chloeflowerbags brand, is the exclusive property of chloeflowerbags or its licensors and is protected under applicable U.S. and international intellectual property laws. You may not reproduce, copy, modify, distribute, or use any content from this Store for commercial purposes without our prior written consent.


11. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS STORE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING.

WE DO NOT WARRANT THAT THE STORE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.


12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHLOEFLOWERBAGS, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE STORE OR ANY PRODUCT PURCHASED THEREFROM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.


13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless chloeflowerbags and its owners, operators, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your use or misuse of the Store or any product; (c) your violation of any applicable law or regulation; or (d) any content you submit to or through the Store.


14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the United States and applicable state law, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or any product purchased from chloeflowerbags shall first be submitted to informal resolution by contacting us at chloeflowerbags@gmail.com. We will use good-faith efforts to resolve any dispute within 30 days of written notice.

If informal resolution fails, any dispute shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in English, on an individual basis. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction for matters involving intellectual property or unauthorized access to the Store.


15. PRIVACY

Your use of this Store is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using this Store, you consent to the collection and use of your personal information as described therein.


16. CHANGES TO THESE TERMS

chloeflowerbags reserves the right to modify, update, or replace these Terms at any time at our sole discretion. The updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the Store following the posting of changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.


17. SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.


18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies posted on this Store, constitute the entire agreement between you and chloeflowerbags with respect to the subject matter herein, and supersede all prior agreements, representations, or understandings, whether written or oral, relating to such subject matter.
