1. ACCEPTANCE OF TERMS
By accessing, browsing, or purchasing from EdwardMakesArt ("Company," "we," "us," or "our") at any of our sales channels, you ("Customer," "you," or "your") agree to be fully bound by these Terms of Service ("Terms"), our Privacy Policy, and our Shipping Policy, all of which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not use our website or place any order.
These Terms constitute a legally binding agreement between you and EdwardMakesArt. Your continued use of our platform or completion of a purchase constitutes your affirmative acceptance of all Terms herein.

3. PRODUCT DESCRIPTION AND MANUFACTURING DISCLOSURE
IMPORTANT — MANDATORY DISCLOSURE REGARDING MANUFACTURING PROCESS:
Due to high demand, products that were previously handcrafted (handmade) have transitioned to industrial-scale manufacturing facilities. By communicating this transition in these Terms of Service and Shipping Policy, EdwardMakesArt assumes no liability for claims based on expectations of handmade or artisan product quality. By completing a purchase, the Customer expressly acknowledges, accepts, and agrees to this condition without reservation.
EdwardMakesArt makes reasonable efforts to display product descriptions and images as accurately as possible. However, we do not warrant that product descriptions, images, colors, dimensions, or other content on our platform are completely accurate, current, or error-free. Products may vary slightly from their displayed images due to manufacturing processes, screen resolution differences, or supplier updates.
You acknowledge that you are purchasing products as described at the time of sale under these Terms, and not based on any prior representations, advertisements, or historical product attributes.
4. ELIGIBILITY AND ACCOUNT USE
By placing an order, you represent and warrant that:
- You are at least 18 years of age or the age of majority in your jurisdiction;
- You have the legal capacity to enter into a binding contract;
- You are not located in a jurisdiction where purchasing from EdwardMakesArt would be prohibited by applicable law;
- All information you provide in connection with your purchase is accurate, current, and complete.
EdwardMakesArt reserves the right to refuse service, cancel orders, or terminate access to any customer at its sole discretion, including for suspected fraud, abuse, or violation of these Terms.
5. ORDERS AND PAYMENT
5.1 Order Acceptance Placing an order constitutes an offer to purchase. EdwardMakesArt reserves the right to accept or reject any order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraudulent activity. An order is not confirmed until you receive an official order confirmation email from EdwardMakesArt.
5.2 Pricing All prices are listed in U.S. Dollars (USD). Prices are subject to change without prior notice. Applicable sales taxes, if any, will be calculated and displayed at checkout in accordance with applicable law.
5.3 Payment Payment is due in full at the time of purchase. We accept payment methods as displayed at checkout. By submitting payment, you authorize EdwardMakesArt to charge the full order amount to your selected payment method.
5.4 Order Errors It is the Customer's sole responsibility to review and verify all order details — including product selection, quantity, size, color, and shipping address — before completing checkout. EdwardMakesArt is not responsible for errors made by the Customer during the ordering process.
6. SHIPPING AND PROCESSING POLICY
6.1 Processing Time All orders require 1 to 3 business days for processing and handling before shipment. Business days exclude weekends and federally recognized U.S. public holidays.
6.2 Estimated Delivery Time Once shipped, estimated delivery is 13 to 20 business days. Delivery estimates are not guarantees. Actual delivery times depend on carrier operations, customs processes (for international shipments), geographic location, and other factors outside EdwardMakesArt's direct control.
6.3 Shipping Carriers EdwardMakesArt ships via third-party carriers. Once a package is transferred to a carrier, EdwardMakesArt does not control the speed, routing, or handling of the shipment. Carrier delays, customs holds, weather events, natural disasters, public health emergencies, labor disruptions, or any other force majeure circumstances do not entitle the Customer to a refund, cancellation, or any other remedy.
6.4 Logistics Delays — No Right to Refund Delays in transit, including delays beyond the estimated delivery window, do not constitute grounds for a refund, partial refund, order cancellation, or chargeback. By placing an order, you expressly acknowledge and accept that shipping timelines are estimates only and that logistical delays fall outside EdwardMakesArt's liability.
6.5 Non-Cancellable Once Shipped Once an order has been marked as shipped and a tracking number has been issued, the order cannot be cancelled under any circumstances. No exceptions will be made. If you wish to cancel an order, you must submit a written cancellation request via email to edwardmakesart@gmail.com during the processing window (1–3 business days after order placement) and before a shipping confirmation is issued. Cancellation requests submitted after shipment will be denied.
6.6 Delivery Address Accuracy The Customer is solely responsible for providing a complete and accurate shipping address at checkout. EdwardMakesArt is not liable for non-delivery, loss, or delay resulting from an incorrect, incomplete, or undeliverable address provided by the Customer. Re-shipment fees, if applicable, are the sole responsibility of the Customer.
6.7 Manufacturing Transition Disclosure — Shipping Policy Due to high demand, products that were previously handcrafted (handmade) have transitioned to industrial-scale manufacturing facilities. 7. RETURNS AND REFUND POLICY
EdwardMakesArt maintains a strict return and refund policy. Please read this section carefully before placing an order.
7.1 Return Eligibility Window Return requests must be submitted in writing via email to edwardmakesart@gmail.com within 90 calendar days of the date of confirmed delivery as recorded by the carrier's tracking system. Requests submitted after this window will be automatically denied with no exceptions.
7.2 Strict Condition Requirements To be eligible for a return, the product must meet ALL of the following conditions without exception:
- The product must be completely unopened;
- All original manufacturer seals, shrink wrap, and packaging must be fully intact and undisturbed;
- The product must show absolutely no signs of tampering, use, manipulation, alteration, or wear;
- The product must be in its original packaging with all original inserts, tags, accessories, and documentation included;
- The product must not have been subjected to any environmental damage, soiling, or odor exposure after delivery.
Products that do not meet every one of the above conditions will be rejected upon inspection, returned to the Customer at the Customer's expense, and no refund will be issued.
7.3 Non-Returnable and Excluded Items The following items are categorically excluded from return eligibility:
- Any product that has been opened, used, or activated;
- Any product whose original seal or packaging has been broken, damaged, or removed;
- Any product purchased during promotional sales, clearance events, or with discount codes, unless a separate written exception is confirmed by EdwardMakesArt;
- Any product damaged after delivery due to Customer mishandling, improper storage, or third-party interference;
- Any product reported outside the 90-day window;
- Any product for which the Customer cannot provide original order confirmation.
7.4 Return Shipping — Customer's Sole Responsibility All costs associated with returning a product to EdwardMakesArt are the sole financial responsibility of the Customer. This includes, without limitation: return postage, carrier fees, packaging materials, insurance, and any customs or duties charges on international returns. EdwardMakesArt will not issue prepaid return labels under any circumstances. EdwardMakesArt is not liable for loss or damage of returned items in transit; Customers are advised to ship returns via a trackable, insured method at their own cost.
7.5 Refund Processing — Inspection Requirement No refund will be issued until EdwardMakesArt has received the returned product and completed a full physical inspection to verify compliance with Section 7.2. EdwardMakesArt reserves up to 30 business days from receipt of the returned item to complete this inspection.
If the product passes inspection, a refund will be issued to the original payment method within 10 business days of the completion of inspection.
If the product fails inspection for any reason, no refund will be issued, and the product will be made available for Customer retrieval at the Customer's expense.
7.6 Original Shipping Costs — Non-Refundable Under no circumstances will original shipping charges paid at checkout be refunded, regardless of the reason for return, including in the event a return is approved. Original shipping costs are entirely non-refundable.
7.7 No Refunds for Preference or Expectation EdwardMakesArt does not issue refunds based on Customer dissatisfaction with product appearance, texture, weight, or quality attributable to the manufacturing transition disclosed in Section 3 and Section 6.7 of these Terms. The Customer's acceptance of these Terms constitutes informed consent to this condition.
7.8 Chargebacks Filing a chargeback or payment dispute with your financial institution without first completing the return process described in these Terms constitutes a breach of this agreement. EdwardMakesArt reserves the right to contest any chargeback with evidence of these Terms, which the Customer agreed to at the time of purchase.
8. DEFECTIVE OR INCORRECT ITEMS
If you receive an item that is materially defective upon delivery or an item that is demonstrably different from what was ordered, you must notify EdwardMakesArt via email at edwardmakesart@gmail.com within 7 calendar days of confirmed delivery, providing photographic evidence of the defect or discrepancy. EdwardMakesArt will evaluate such claims on a case-by-case basis and, at its sole discretion, may offer a replacement, store credit, or refund for the defective or incorrect item only. EdwardMakesArt's liability in such cases is limited to the purchase price of the affected item excluding original shipping costs.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
EdwardMakesArt's total liability to any Customer for any claim arising out of or relating to a purchase shall not exceed the actual amount paid by the Customer for the specific product giving rise to the claim, excluding any shipping charges.
IN NO EVENT SHALL EDWARDMAKESART BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF USE, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR PLATFORM OR PRODUCTS, EVEN IF EDWARDMAKESART HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be excluded under applicable federal or state consumer protection law.
10. DISCLAIMER OF WARRANTIES
ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. EDWARDMAKESART EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. INTELLECTUAL PROPERTY
All content on EdwardMakesArt's platform, including but not limited to logos, graphics, product images, text, and trade dress, is the exclusive property of EdwardMakesArt or its licensors and is protected under applicable U.S. intellectual property law. Unauthorized reproduction, distribution, or use of any content is strictly prohibited.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or any purchase shall first be submitted to good-faith negotiation by emailing edwardmakesart@gmail.com. If the dispute is not resolved within 30 days, it shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, to the extent permitted by applicable law.
CLASS ACTION WAIVER: To the fullest extent permitted by law, you agree to resolve disputes with EdwardMakesArt on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
13. CONSUMER RIGHTS — STATE-SPECIFIC NOTICE
Nothing in these Terms is intended to waive any rights you may have under applicable federal or state consumer protection law that cannot be contractually waived, including rights under the Magnuson-Moss Warranty Act, the Federal Trade Commission Act, or applicable state consumer protection statutes.
California Residents: Pursuant to California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
14. FORCE MAJEURE
EdwardMakesArt shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor strikes, carrier failures, supply chain disruptions, or cyberattacks.
15. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and Shipping Policy, constitute the entire agreement between you and EdwardMakesArt with respect to your use of our platform and any purchases made, and supersede all prior communications, representations, or agreements on the same subject matter.
17. MODIFICATIONS TO TERMS
EdwardMakesArt reserves the right to update or modify these Terms at any time. The revised Terms will be posted with an updated effective date. Your continued use of our platform or placement of an order following such posting constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
